Terms of Use

1.Who we are and what these terms cover

12 Stones is operated by What's Next Horizon Incorporated, a corporation existing under the laws of Canada. These Terms of Use (“Terms”) form a binding agreement between you and the Company governing your access to and use of the 12 Stones mobile application and related services (together, the “App”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

2.Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your province, state, or country of residence, you may use the App only with the agreement and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. You represent that the information you provide when creating an account is accurate.

3.What the App is

The App provides faith-based discipleship content, including written and audio sessions organized around twelve “stones,” daily reflections, progress tracking, and an AI companion called “the Guide.” The content is offered from a Christian perspective for spiritual encouragement and education.

4.The Guide (AI companion)

The Guide is an artificial-intelligence feature that generates responses from within the 12 Stones framework. The Guide can produce information that is inaccurate, incomplete, or not suited to your situation, and its responses do not represent the personal advice of the Company. The Guide is not a pastor, counselor, physician, therapist, lawyer, or financial advisor, and nothing it says is professional medical, mental-health, legal, financial, or spiritual-direction advice. Do not rely on the Guide for any decision that warrants a qualified professional. The Guide is not an emergency service; in an emergency, contact local emergency services.

5.Not professional advice; not a crisis service

All content in the App, including the Guide, is for general informational and educational purposes. It is not medical, mental-health, psychological, legal, financial, or other professional advice, and it does not create any professional-client relationship. The App does not provide crisis intervention. If you are in crisis or may harm yourself or others, contact emergency services or a crisis line immediately (in Canada and the U.S., call or text 988).

6.Health and wellbeing

Body-related content concerning exercise, nutrition, and rest is general and educational. Consult your physician before beginning any new exercise or nutrition program. You assume all risk arising from physical activity you choose to undertake. Stop and seek medical care if you experience pain, discomfort, or other warning signs.

7.Accounts and security

You are responsible for your login credentials and for activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

8.Subscriptions, billing, and cancellation

Some features require a paid subscription. Subscriptions are sold and billed through the Apple App Store and are subject to Apple's terms. Auto-renewing subscriptions renew automatically at the then-current price unless cancelled at least 24 hours before the end of the current period; your Apple ID is charged for renewal within 24 hours before the period ends. Manage or cancel your subscription in your App Store account settings. Except where required by law, payments are non-refundable, and refunds for App Store purchases are handled by Apple. A “Founding Member” or other one-time purchase, where offered, grants the access described at the point of sale and is likewise non-refundable except as required by law. Prices may change on a prospective basis with notice as required.

9.License and acceptable use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use. You agree not to copy, redistribute, resell, scrape, reverse-engineer, or create derivative works from the App or its content; not to use the App unlawfully or to harass or harm others; and not to misuse the Guide (for example, to attempt to extract content in bulk, to generate harmful content, or to use it as a general-purpose assistant outside its intended purpose).

10.Intellectual property

The App and its content — text, audio, graphics, the 12 Stones name and framework, and the Guide — are owned by or licensed to the Company and are protected by intellectual-property laws. All rights not expressly granted are reserved. Scripture quotations are used under the terms of their respective translations; translation attributions appear where applicable.

11.User submissions

Messages you send to the Guide and other inputs you provide are processed to operate and improve the App as described in the Privacy Policy. You are responsible for what you submit and grant us a license to use submissions for the limited purpose of providing and improving the App.

12.Disclaimer of warranties

THE APP AND ALL CONTENT, INCLUDING THE GUIDE, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT OR GUIDE OUTPUT IS ACCURATE, COMPLETE, OR RELIABLE. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you, and you may have rights that these Terms cannot override.

13.Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR WELLBEING, ARISING FROM OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE APP OR THE GUIDE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID THE COMPANY FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR CAD $50. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

14.Indemnification

You agree to indemnify and hold harmless the Company from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the App or your breach of these Terms, to the extent permitted by law.

15.Changes to the App and these Terms

We may modify or discontinue features, and may update these Terms from time to time. Material changes will be communicated in-app or by other reasonable means. Continued use after changes take effect constitutes acceptance.

16.Termination

You may stop using the App at any time. We may suspend or terminate your access for breach of these Terms or as required by law. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) survive.

17.Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Subject to any non-waivable rights you have as a consumer, you agree that the courts located in Ontario have exclusive jurisdiction over disputes arising from these Terms.

18.Apple-required terms

These Terms are between you and the Company, not Apple. Apple is not responsible for the App or its content. To the extent the App is acquired through the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The standard Apple Licensed Application End User License Agreement (the “Apple Standard EULA”) also applies to your use of the App; where these Terms and the Apple Standard EULA conflict, the more protective term for the user governs the consumer-facing relationship, and the Apple Standard EULA governs the Apple-specific matters it addresses.
